The Failure of the 28-Point Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis sparked by the announcement of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been contained. A Washington representative spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its response: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The chain of conflicting incidents captured the harsh reality of the current period. By day, negotiation efforts are fought: hopeful statements are released from various governments. Significant resources is devoted on containing particular approaches. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the present situation of Ukraine's vulnerability was exposed. Ukraine is capable of detecting projectile deployments from enemy soil, a ability provided through timely intelligence. From vantage locations, Ukrainian air force fighter jets that had been scrambled to engage hostile cruise missiles streaked across the sky – advanced fighter aircraft delivered to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense thundered: defensive missiles targeted at a incoming threat. This was a modern interception technology at work, probably provided by partner states. Every launch shakes the surroundings, shaking the windows. The instant of fear quickly gives way to grim resignation: maybe the incoming missile won't hit its mark this time, sparing the city from catastrophe and additional electricity failures.

Continuous Dangers

Soon after, a heavy machine gun engaged a unmanned aircraft somewhere nearby, part of a defensive team – most likely imported technology. Regrettably, the bullets missed the opposing UAV – it pressed on overhead toward its objective.

Periodically, this carried on until dawn. Kyiv faced the daybreak reports: seven people killed, devastation and infrastructure problems in many homes as a result of the evening attack. As customarily, everyone still continued their routines – enduring hostilities. But those entire period illustrated Ukraine's essential dependence on international aid – a dependence that European nations are clearly incapable to fill in the short term.

Ineffective Peace Efforts

The detailed framework from American leadership sparked intense emotion, discussion and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and bilateral conferences.

Every new approach from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with allied governments, manages to fend off. They manage the tension but never actually achieve victory. This cycle will, no doubt, continue.

Political Considerations

It is tempting to accuse specific actors of repeatedly advocating Russian terms. But that does not seem to be the entire situation. Washington functions according to a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The US administration assumes that it is unfeasible to force Russia to relinquish the land that it presently holds in Ukraine's south or east.

The issue is that while accepting these circumstances, Washington does little to prevent Kremlin actions, through words or deeds, from believing that the current condition will not change more in its advantage in the near future.

Divergent Views

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its supporters are nearing depletion. Their incentive to sign a deal that does not give them the greatest potential benefit is almost completely absent. There may be multiple initiatives to achieve ceasefire, but they will carry on as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing civilians and areas but avoiding a total frontline collapse until situations evolve in its favour.

Current Realities

Factually, there are no real preconditions for a ceasefire. Now, subjective factors are entering the equation: leadership ambitions to mediate resolution and achieve global acclaim, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the country's interests against any plan Kyiv finds unsuitable, so that their attention does not switch to internal issues. And although their task will now be considerably more difficult after recent developments, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Summary and Prospects

It took a mere seven days to terminate the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by Washington, opposition by Ukraine and the remaining European nations, along with calming attempts of representatives, and finally, current information leaks, all did their job.

While new initiatives based on established approaches are imminent, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off political attacks from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to change the course of events, if they maintain solidarity and enhance their military capacity at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the coming months, mainly require continued Western support.
